How much can I drink before driving home?

A Louisiana lawmaker who sponsored a bill that would require people to have a designated driver before being served alcohol in bars and restaurants in the state has admitted that the mandate would be difficult to enforce.

Additionally, the bill also fails to address the fact that it is legal to consume alcohol in a bar or restaurant and then drive home so long as the driver is not impaired. (The lawmaker said he might propose a study on drunk driving instead.)

But how much can a person have to drink in a bar or restaurant before driving home?

The answer to that question is: it depends.

In Louisiana and most other states, it is illegal to drive with a blood alcohol content level of .08 or higher, but that doesn’t translate to an exact number of drinks as there are numerous factors that can affect a person’s ability to absorb and tolerate alcohol.

According to the University of Notre Dame, food consumption, strength of a drink, body weight and body type, gender, mood, medications, illness, and fatigue can all affect intoxication. What that means is that the same amount of alcohol can cause one person to be impaired and another person to be okay to drive.

It also means that evidence is extremely important in a DUI defense case. After being charged with a DUI it’s extremely important to contact an experienced criminal defense lawyer right away so that the lawyer can begin gathering evidence and building your case.

While many people don’t realize it, a DUI arrest involves important constitutional rights that may have been violated. Talking to an experienced defense lawyer is the only way to make sure that your rights are protected.
