Off-duty cop suspected of DWI after helping crash victim

We've written many times on our blog about how authorities in Louisiana take drunk driving very seriously -- regardless of who might be suspected of drinking and driving. A textbook example of this took place recently, when a Baton Rouge homicide detective was booked on DWI charges after being involved in a car accident that did not seem to be his fault.

The officer, a five-year veteran of the force, was involved in a two-car accident on Interstate 12 in the middle of the night recently. A woman driving a minivan lost control of her vehicle, possibly due to icy conditions, and her vehicle flipped onto its side. She suffered minor injuries and the officer -- whose vehicle was tangentially involved in the accident -- helped to pull her out of the wreckage.

As a result of the crash, the officer was suspected of having been drinking -- even though the crash did not appear to be because of his negligence. He submitted to a breath test, which showed a blood alcohol content well above the legal limit. As a result, he was booked into East Baton Rouge Parish Prison on a charge of driving while intoxicated.

The incident caused immediate harm to the officer's career; he was placed on administrative leave from the police department. It's not clear if the circumstances of the accident, particularly how he pulled an injured victim from her car, might play into any decisions about his circumstances. In any case, it is likely that he would consult with an experienced drunk driving defense attorney about his situation.
