Duson man pleads guilty to manslaughter, faces 20 years in prison

On Tuesday, a Duson man pleaded guilty killing his domestic partner. He could get up to 20 years in prison for the crime.

According to the 15th Judicial District Attorney's Office, the 30-year-old man killed his partner after the two of them got into an argument at a casino in Duson.

As part of a plea agreement, the defendant pleaded guilty to manslaughter rather than homicide. One element of the plea agreement was a sentencing cap, which put the amount of time the man will serve at more than two decades.

The plea agreement is what made us want to write about this case.

Now, we want to be clear that this man absolutely deserves to be punished for killing his partner. We also want to point out, however, that the law punishes homicide (the intentional killing of a human being with "malice aforethought") differently than it does manslaughter (actions resulting in the death of a human being that lack the intent element of homicide).

We do not know all the facts of this case, but we would assume, given what we do know, that there was some dispute over whether the man planned and intended to kill his partner (showed "malice aforethought," in other words), which would make it murder, or whether it was something that happened in a moment of heated passion, which would make it a lesser degree of homicide or manslaughter.

Experienced criminal defense lawyers are skilled at assessing the facts as they are, examining the applicable law and then arguing for the position most favorable to their client. Again, we certainly are not saying this man should escape punishment, but we do believe he should only be punished proportionately, justly and in accord with our laws. In this case, the plea agreement may have helped serve those ends.
